NJ police officers won't face criminal charges for beach altercation, prosecutor says

WILDWOOD, N.J. A Philadelphia woman whose violent arrest at a New Jersey beach over Memorial Day weekend was captured on video says she hurt her neck and back in the scuffle and has feelings of anxiety. "I cooperated. I did everything I was asked to", Weinman said. "So when they smashed my head into the ground, I had all this sand in my mouth... when they got me on my stomach, I turned around to go spit it out", Weinman said. "One situation doesn't define me".

Police bodycam footage showed one officer pinning Weinman to the ground, grabbing her hair and punching her in the head twice after she refused to cooperate.

Weinman can be heard telling the officer to "get the f-- off", prompting him to respond, "That's it", and he begins hitting her.

"Now that this happened, it's a trauma", Emily Weinman, 20, said in an interview on ABC News' "Good Morning America" with co-anchor Amy Robach.

She has been charged with resisting arrest, aggravated assault, and assaulting a police officer.

Police said that Weinman struck the officer before he tried to handcuff her, something Weinman denies.

"I've been really anxious over it", 20-year-old Emily Weinman, the mother of a 1-year-old daughter, told the television show. "It just escalated to that point to where they wanted to lock me up because I wouldn't give them my name because I did everything they said to do", Weinman said.

Weinman's attorney, Stephen P. Dicht, took a different view.

Cape May County Prosecutor Jeffrey Sutherland reportedly said that the officers in the violent confrontation have not been charged with any wrongdoing, and are not expected to be.

"The Saturday she was taken into custody, she was in custody for about 40 minutes, she was charged with misdemeanors".

But the officer told her she still could not have the alcohol under 21. "Kind of upset. The things people say about me".

He said that something one of the officers said in one of the clips - that Weinman was going to get "dropped" - was a threat and an offense.

It still isn't clear if Weinman plans to file a lawsuit against the Wildwood police. Weinman then is seen spitting toward the officers.

The goal of the preliminary investigation was to determine whether the Professional Standards Unit ("PSU") of the Cape May County Prosecutor's Office would conduct the Internal Affairs investigation based on possible criminal charges against the arresting officer (s), or whether the Wildwood Police Department would conduct an Administrative Internal Affairs Investigation.

Sutherland said was aware of the emotion surrounding the video but made his decision based on facts.
