McCloskey posted his juror ID badge on Facebook to prove he was on the alternate jury. However, his reputation had been tarnished over the years as nearly 60 women have come forward and accused him of sexual assault. Judge Steven O’Neill advised jurors when the trial ended on Saturday outside Philadelphia, after a week of testimony and 52 hours of deliberations, that they need not discuss the case, even as the public debates whether age, race, gender or other issues separated them.

“It was the craziest, eeriest bus ride I’ve ever taken”, McCloskey said.

“The key to retrying a case is to do it differently the second time, because the defense expects you to do it the same way”, said Troiani, whose client is on board for a retrial.

Though the names of jurors have not been publicly released to the media, alternate juror Mike McCloskey spoke to Pittsburgh radio station WDVE-FM about his experience in the courtroom and being sequestered from the active jury.

Immediately following the court’s declaration of a mistrial, District Attorney Kevin Steele announced that he would retry the case.

The jury on Saturday deadlocked on charges that Cosby drugged and molested a woman in 2004, resulting in a mistrial. Cosby says the encounter was consensual.

“The prosecution of Bill Cosby for the aggravated indecent assault of Andrea Constand was widely viewed as a “tough case”-and no doubt the retrial will be tough as well-but as District Attorney Kevin Steele rightly observed in his comments following the mistrial, prosecutors ‘should take on the tough cases”.

Former federal prosecutor David Weinstein said Cosby’s celebrity nearly certainly played a role in the jury’s deliberations, perhaps to convince “two or three jurors that it’s impossible to convict Dr. Huxtable, to convict Fat Albert. that he couldn’t have done this frightful thing”. Cosby faces a possible maximum sentence of 15 to 30 years in prison if convicted of the charges.
